Tobin and Schreiber accept whatever fee, if any, the condemning authority is required to pay, as our sole fee. With respect to business damages, the burden is on the property owner to make and establish what they are entitled to. The condemning authority is responsible for your attorney’s fees.
In Florida, the condemning authority is required to pay your attorney’s fees and costs in any eminent domain action. Attorney’s fees are paid separately from the business or property owner’s compensation and do not reduce their recovery for the property taken. Clients are not responsible for paying Tobin and Schreiber for pursuing these types of claims.
