FDOT attempted to take an iconic diner/restaurant on Biscayne Boulevard in Miami, Florida. The case was filed as a “whole take” as part of the government’s strategy to avoid paying business damages. Mr. Tobin negotiated a settlement whereby FDOT agreed to trade a larger parcel of property it owned in the immediate vicinity of the property it was taking and allowed the restaurant to continue and expand its operations.
