Government’s Attempt to Coerce a Settlement Fails

The condemning authority reduces its offer and appraised value of the property by approximately $1,100,000 because of environmental contamination discovered on the property in an effort to coerce a settlement at its appraisal in the approximate amount of $2,400,000. The reduction was the alleged cost to remediate the contamination. Mr. Tobin established that the cause of the contamination was leakage from the adjacent airport owned and operated by the condemning authority. The case was ultimately settled for approximately $3,700,000 together with the County’s agreement to remediate the contamination at its sole cost.
