Mr. Schreiber represented the owner of a food processing and distribution center in a jury trial against the FDOT. FDOT condemned a portion of land adjacent to the facility’s loading bays that trucks used to access the loading bays. FDOT and its experts alleged the taking would have a minimal impact on the facility’s operations and offered minimal damage in addition to the value of the land taken. At trial, Mr. Schreiber established through testimony of a traffic engineer and cross-examination of the state’s engineer that the entire facility needed to be redesigned and partially relocated as a result of the taking. The jury awarded several million dollars over and above the compensation that FDOT deemed “full compensation.”
